I was talking about this with my wife.
I just don't see how a guy can get raped.
Just think if some ugly girl knocked you over with a beer bottle and then started to suck you off. Would you tell her to stop ? No matter how ugly the girl, I think the guy would enjoy it.
What do you think ?

Yes. ****** acts you don't want, which are forced on to you = rape. If the above happened to me I wouldn't be very happy, I don't know if I'd report it to the Police though, I would of course report the GBH though!...

Sorry seoul, that kind of sounded like I was jumping on you. Not inteded. Answer is it depends, each state is different. If consent is a component of the statute then you might have a point. That would be odd because it would in effect put the burden on the accused to show that the victim intended to consent or not to consent. The more normal situation for a rape statute is non consensual but the non-consent burden is on the state. Does that make sense? If mere alcohol use was enough to destroy all informed consent in all cases then every man or woman who has to much to drink and does it would = rape and that is not the case.
Now, passed out would be a different matter. But just drunk usually would not work.
For example, TN's rape law requires the raper to know of the lack of consent. But, a following section says that if fraud is used to gain the *** then its rape. Also, "mentally defective" can destroy consent, but only if the raper knows. Result of all of this is that just being drunk is not enough, by itself, to meet most rape definitions. So, if you slip someone a drug and then *** them up the consent element is gone b/c you used fraud to make it happen. But without fraund the state will have to prove that the victim did not consent and that the raper knew of the lack of consent. This is common, though no universal.
Now somebody will go and find an exception and that is OK. I'm generalizing. Strictly speaking the answer to Jack's ? legally is yes. Men get raped if they do not consent and the woman knows of hte lack of consent. However, practically I see the problem b/c men can't perform without arousal and there is some compliance nad possibly even consent involved in that.

ahhhh, thanks for the great answer. i know that at least in illinois, it's not rape if both people are not drunk and they consent. everything else is considered rape. :|

To him, it's a matter of principle. I disagree. I think a woman CAN take advantage of a man. Men can develop emotional attachments, too. I've had girl friends hook up with guys (with a one-nighter in mind). The guys call afterwards, and she's not interested. He feels used. Depends on the guy, I guess. I know guys that would take any form of ***, no matter what the circumstances. I also know other guys that won't sleep with women unless they are involved in a relationship or married. Rape is a different story, though. Honestly, I can't see how a woman can force herself on a man against his will. I've never heard of it. Can you you 'keep it up' under that kind of stress? Also, in general, men have greater upper body strength, so they can defend themselves. I'm sure there are some circumstances where this has happened, though. Rape is about power, not ***.

I agree with that Nawlins. I'm just sayin it is a little different for men b/c arousal will happen at times when consent is absent. In those cases rape is possible for men. But, if arousal is impossible and the law requires that a ***** penetrate a ****** (like it does in TN) then rape may not be possible. It still might be illegal as ****** assault or something else but the lack of an erection might make rape impossible. Does that make sense?
The difference is that as far as the ****** act is concerned consent is irrelevant when a man rapes a woman. Man with erection and the strenght to force his will on a woman will make arousal/lack of arousal irrelevant.
I think Jack's point was the one that molly747 made and I, too, disagree with that as do you and molly747. Nonconsent is the key. If a man does not consent and the elements of rape are met then it is rape. Agreed.

good points, molly747. As Nawlins pointed out lack of consent is the hallmark of rape. I have pushed us off course with legal definitions and other stuff, but you guys are both right. Non-consensual ****** activity is certainly criminal even if not properly characterized as rape.
