What if Iraq would have had PMC's guarding the waterplant and so on in the beginning of the war would they have been regarded as an Illegal Combatant or something else?

If they were just guarding the waterplants, they would be like any other security guards and just left alone. But if they were attacking americans then they would be targeted.
