View Full Version : Justice Dept. Investigates Arizona Sheriff for Enforcing Immigration Law

The Department of Justice (DOJ) has launched an investigation of the Maricopa County Sheriff's Office in Arizona following requests by congressional Democrats and allegations by liberal activists that the department has violated the civil rights of illegal aliens.

Reps. John Conyers (D-Mich.), Jerrold Nadler (D-N.Y.), Zoe Lofgren (D-Calif.), and Robert Scott (D-Va.) requested the investigation, and activists groups such as National Day Laborer Organizer Network and ACORN launched petition drives and rallies in support of the probe.

The investigation focuses on Sheriff Joe Arpaio and dozens of officers under his command who were trained through the Department of Homeland Security's Immigration and Customs Enforcement's Agreements of Cooperation in Communities to Enhance Safety and Security (ACCESS), which partners federal and local law enforcement to enforce immigration laws. (The Homeland Security’s Immigration and Customs Enforcement division is known popularly as ICE.)

In a letter dated March 10, 2009, Loretta Smith, acting assistant attorney general at the DOJ, detailed what her department would be investigating:

"This is to inform you that the United States Department of Justice is commencing an investigation of the Maricopa County Sheriff's Office (''MCSO'') pursuant to the pattern or practice provisions of the Violent Crime Control and Law Enforcement Act of 1994,42 U.S.C. §14141 ("Section 14141") and the Omnibus Crime Control and Safe Streets Act of 1968,42 U.S.C. § 3789d ("Safe Streets Act"), and pursuant to the prohibitions against national origin discrimination in Title VI of the Civil Rights Act of 1964,42 U.S.C. §§ 2000d to 2000d-7 ("Title Yr') and the Safe Streets Act, 42 U.S.C. § 3789d(c)."

The letter continues: "The investigation will focus on alleged patterns or practices of discriminatory police practices and unconstitutional searches and seizures conducted by the MCSO, and on allegations of national origin discrimination, including failure to provide meaningful access to MCSO services for limited English proficient (LEP) individuals."

"In conducting the investigation, we will seek to determine whether there are violations of the above laws by the MCSO," the letter says.

Sheriff Arpaio's efforts to enforce immigration laws have been the focus of previous criticism, but Arpaio has defended his department and the results his ICE-trained officers have netted.

Concerning the DOJ’s investigation, Arpaio told CNSNews.com: “I will not back down. What I am doing is upholding the laws of the state of Arizona, and I will not be persuaded to turn my back on my oath of office as sheriff of this county.”

In an August 2008 press release, Arpaio's office detailed those results.

"While the Sheriff’s illegal immigration and human smuggling operations conducted on the streets and roadways here have netted nearly 2,300 arrests, another very successful effort to locate illegal aliens has been quietly happening inside Maricopa County Sheriff Joe Arpaio’s jails," the release said.

It continues: "Despite the growing criticism of the Sheriff’s illegal immigration fight by some valley politicians and activists, Sheriff Arpaio says 60 detention officers trained by ICE officials have conducted over 106,000 interviews and investigations of inmates booked into jail since April of 2007.

"In those 18 months, 16,000 inmates were determined to be illegal aliens. Either they have already been deported or will be deported after being tried and/or serving their sentences for crimes committed in the valley. The work being done be Arpaio’s detention staff is a likely contributor to the recent reduction in crime in the valley,” the press release added.

"That number of 16,000 represents a full one-third (1/3) of all inmates in the United States who have had holds placed on them after being identified by jail or prison officials as illegal aliens."

The press release goes on to say that 20 percent of inmates in the Maricopa County Jail are illegal aliens and that of those, 2,000 illegal aliens - 70 percent - were arrested for felony crimes.

Those felony crimes committed included the following: forgery, 12 percent; kidnapping, 10 percent; aggravated assault, 7 percent; driving under the influence, 7 percent; drug charges, 27 percent; robbery, 3 percent; murder, 3 percent; and theft, 4 percent.

The Democratic Congress members have also asked Homeland Security Secretary Janet Napolitano to launch an investigation into the training provided by ICE.

Believe me, Sheriff Joe is a slut for publicity, and is often overzealous in the pursuit of it. He has some programs I support and many that make me cringe, and it appears has not been using resources well or wisely in this particular instance.

Yes, we have a serious problem with illegal immigrants in Arizona, and properly targeted sweeps and investigations most of us are OK with. By all means, Joe, look in your own damn jails -- and why exactly should this get you praise? Isn't this common sense and should have been done long ago, routinely?

Showing that many of the local governmental agencies unknowingly contract with businesses that use illegals is great, he deserves a lead-off story on that one (based on tips, btw). But there are reports locally that he encourages random searches, seizures, and sweeps of Hispanic-looking people, which does possibly violate the Constitutional rights of the citizens and 'legals' caught up in his zeal.

Apparently our new Dept. of Justice adheres to Chief Wiggum's advice "I'd rather let a thousand guilty men go free than chase after them".

That's absolutely remarkable...this one guy is responsible for such a huge percentage of those being ID'd as illegals. Just imagine if the rest did their jobs too.

reminds me of clintons justice dept stopping all of those embarrassing probes into illegals voting in western states. after they allowed them to obtain driver license;s good ol motor voter law registrations.

I'll agree with most of what you said minus the "resources used wisely". He seems to be alot more successful than most of our entire federal government on this issue.

We've got a similar problem here in Texas. However, the illegal aliens and their legal families are more organized it seems. These kinds of "civil rights" threats pop up alot. Pretty much if any LEO/ICE ask a dark skinned individual who speaks little or no english with a latino accent if they have a green card or if they are a citizen you are profiling and a racist.

This abuse of "civil rights" lawsuits douchebaggery is getting too commonplace these days. Ranks right up there with traffic stops and "racial profiling" despite not being able to tell the race till you walk to the driver side window.

The OP is from Arpaio's own PR release. The reality doesn't quite match up with his self-appraisal. With rising cartel-related serious crime in AZ, we need sound, really aggressive policing around here, believe me. I have no trouble with taking a hard line, but have little use for bluster.

Several local police depts are unhappy with Sheriff Joe's immigration sweeps -- he has sent 100 deputies to another police dept's turf at all hours with no warning, leading to some close calls, yet he has cut out providing protection to a number of small 'tweener' suburbs (formerly rural and too quickly leapfrogged by growth) that he was covering as County Sheriff. He says it's not his job and he doesn't have the manpower.

The illegals he finds are mainly guys that have been arrested by local police depts and are being held or serving time in his County jail (so ...of course they're felons...)



"Through his various activities, Arpaio has identified more than 18,000 illegal immigrants. The vast majority, about 15,600, has been as a result of checking the immigration status of those booked or incarcerated at the jails.
Only 103 have been netted through the immigration sweeps.
In other words, the sweeps are the least effective and productive thing Arpaio is doing about illegal immigration. They have produced only about one-half of 1 percent of those apprehended." -AZ Republic, last April.

I love this part of the DOJ letter:

Hispanic?

This is the first shot in the war to give 20-million illegals amnesty and the fast-track to citizenship. That could possibly be Teh Chosen Ones strategy to win in 2012.

Yeah, someone tried that on me once. I pulled them over for speeding, and when they went to court he kept going on about how I pulled him over because he was black. When it was my turn to speak all I said was "Your honor, at the speed he was traveling I could not tell who was driving." He lost......

As for some of the responses above...

Frankly, I don't have a problem with profiling. It serves a purpose. If authorities know that 5'10" blonde female from the North East is planning to hijack an airline I'd expect to be stopped at the airport and run through a thorough security check. What I don't expect and what I find to be a complete and utter waist of funding and resources is for my 70 year old grandfather to be held up at the airport so the 5'10" blonde females from the North East won't feel picked on.

If you fit the profile and are not guilty do your country the service of cooperating.

Maybe if some communities ceased harboring and/or turning a blind eye to criminals living among them and did their country the service of helping law enforcement, profiling wouldn't be as necessary.

Blame the criminals among you, not the guys trying to bring them to justice.
