Judge rules terrorist can sue over torture memos

SAN FRANCISCO (AP) - A federal judge says that a convicted terrorist can sue a former Bush administration lawyer for drafting the legal theories that led to his alleged torture.

The order by U.S. District Judge Jeffrey White of San Francisco is the first time an administration lawyer has been held potentially liable for the abuse of detainees.

White refused to dismiss Jose Padilla's lawsuit against former Justice Department attorney John Yoo on Friday. Yoo wrote memos on interrogation, detention and presidential powers for the department's Office of Legal Counsel from 2001 to 2003.

The 38-year-old Padilla is serving a 17-year sentence on terror charges. He claims he was tortured while being held nearly four years as a suspected terrorist.Article at http://www.breitbart.com/article.php?id=D98Q07DG1&show_article=1&catnum=0

What a load of bullcrap. Yoo didn't draft any legal theories, he just investigated what the current laws allowed the gov't to do.

In a perfect world this would be qualified as treason, and punishable by death by firing squad.

PS: Always love how democracies lay out the very mechanisms to sabotage itself; and there are always judges eager to prover their understanding of legal procedures even if it means benefiting criminals. We have a lot of those kind of judges in my country. My best guess is that he's a former criminalist lawyer and old habits die hard.

well done democracy....I'm not too bothered with this - even a convicted terrorist has certain rights. If he can sue, let him. After all being able to sue doesn't always mean that he will win, and if the government did anything illegal steps should be taken.
