China frees waitress over killing

A Chinese waitress who killed a local official after he allegedly assaulted her has been set free by a court in Hubei province.

The court ruled that Deng Yujiao, who worked at an entertainment centre, was guilty of intentional injury. But the 21-year-old, who said she acted in self defence, was released without punishment. Her case has received widespread sympathy across China, and has been widely discussed on internet forums. Police initially treated the case as murder, but this led to a public outcry. The charge was later changed to assault.

'Excessive defence'
After a two-hour trial, the court found that Deng had acted with "excessive defence" when she killed Deng Guida and injured another man, Huang Dezhi, with a knife after she refused to join them in a bath on 10 May, reports said. The two men were township officials of Badong county. A police statement said that the men pushed, shoved and insulted Ms Deng, China's official Xinhua news agency reported. According to lawyers quoted in Caijing business magazine, Deng Yujiao has been diagnosed with a "mental imbalance". This was cited as one reason why the court released her without punishment. Chinese websites have praised Deng for fighting injustice, and posted poems and songs in her support. The strong public interest in the case prompted the local government in Badong to post a statement online promising a fair hearing. At least 500 of Deng's supporters gathered outside the court to hear the verdict.
Well it's a relief that she has been set free.

She's lucky.
But I wonder how many innocent Chinese were convicted or framed by CCP cadres under similar circumstances and got away with it?

I hope some good will come out of this in terms of rule of law with an independent judiciary.

The pressure to release this young woman was intense. I really feel she was released because of fear by party officals of a civil up-rising in Badong County, central China's Hubei Province

don't be so happy, as the CP judge sentenced ,she's "not been punished",but still "guilty", that means she's always been looking as a "criminal" person, although the fact she's not; and there's no any blame on the court about the damn officers who almost rape her; (but it's good to heard one of living officer's ***** was almost cut-off, yes ,it's "unfunctional" now)

All judges in China must belong to the CCP. Thus exist a conflict of interest which would've gone against the defendant.

The CCP is trying to save face in a potentially explosive situation.

Where justice ends, tyranny begins.

and she's not Free yet, she's in hand of CCP still ,and offiically said they will "heal" her "mental illness", which confirmed by her mother.

Yes.She was judged to be a little unjustifiable self-defense.But because she has got hypochondria and was be threaten,she will not be punished.
