The Senate Criminal Justice Committee will consider HB 823 by Representative Terry Keel (R-Austin) and Senator Juan Hinojosa (D-McAllen) on Tuesday, May 10, at 1:30 p.m. or upon Senate adjournment in Room E1.016 of the State Capitol in Austin. HB 823 takes important steps towards clarifying that law-abiding Texans may carry a handgun for protection in their vehicles without a CHL.

What is the law now? In Oregon, a non-felon may have a handgun in their car as long as it is in plain view, ie on the front or back seat or on the dash board, or someplace where it is not easily accessable to the driver, such as the trunk or the back of a station wagon. If a person wants to put their pistol under the seat, in the glovebox, or somewhere not visible but within reach, they must have a CHL.

There is a defense to prosecution in the Penal Code that says you can carry when you are "Traveling". Nowhere is traveling defined so it is up to the LEO and judge if you are arrested to determine the definition of traveling. HB823 will clarify this. There is also a provision in this bill making it unlawful for an employer to keep you from having a weapon in your vehicle while on their property unless they have a secure parking area (i.e. armed guard).
