How can you even tell he kicked him and wasn't just making the motion or kicking something away?

And depending on what happened before that point it might have been warranted.

I agree, usually when you kick someone that's laying on the ground your leg doesn't fling into the air, unless your doing an axe kick which is the perfect kick for this situation p-) and anyway that angle sucks if your planning to hit someone in the head
