LAKELAND, Fla. - An appeals court has ordered the release of an alleged Internet ****ographer who was arrested after he posted grisly photos U.S. soldiers took in Iraq and Afghanistan.
The 2nd District Court of Appeal did not state in its brief order Thursday why Chris Wilson should be released, but said a written opinion would follow. He left jail a few hours later.
Wilson, 28, was arrested on obscenity charges in October for operating a Web site which sparked national attention for giving soldiers free access to ****ography in exchange for posting pictures from the Iraq and Afghanistan wars.
His attorney has suggested the government arrested Wilson for posting naked photos as a way to stop him for posting the war photos, saying that few alleged Web ****ographers are charged with obscenity.
Polk County prosecutors requested in November that Wilson's $151,000 bail be revoked because his Web site continued to operate.
After reviewing 30 pictures and three videos from Wilson's site, Circuit Judge J. Dale Durrance revoked Wilson's bail earlier this month, finding there was probable cause to think the pictures were obscene.
The judge ordered that Wilson, a former Eagle Lake police officer, be held without bail until his trial.
The defense has argued that Wilson's case illustrates how the obscenity statute can be misused by law enforcement seeking to interfere with First Amendment rights.
The defense claims that the pictures and videos on his site are protected by the First Amendment until a jury determines they are obscene. They said Wilson's incarceration was illegal and equal to "prior restraint" and "prior punishment."

He is NOT enforcing the laws of Florida, the scope of it goes WAY beyond florida. It's a small-town sheriff trying not only to fight something that is on a major, international scale and therefore outside his jurisdiction through various laws and regulations, he is allso going against the 1st amendment.
A small town sheriff in hicksville, USA can't just go and charge every criminal in the world, especially when there's no crime commited.
Since when was your basic, everyday **** illegal anywhere in the western world?

Sorry, selling **** for death photos is illegal in Florida. He was in Florida. He got owned as per Floridian law. End of story. What a europeon thinks, means jack **** here. Dealing in content like that is forbidden in Florida as well as almost all states. There's a reason you can't stroll into a store and pick up the latest release of Faces of Death in the US. Gee let's think about why...Hmmm...Could it be because IT IS AGAINST THE LAW? Also the US isn't charging criminals across the world - they are charging a criminal within their jurisdiction. His website may have been in europe but his illegal operation was in Florida. Saying you can't charge someone in your country for violating laws via the internet in other countries would be like saying I could run a warez website in Sweden and face nothing. Reality says different.
The crime commited had nothing to do with the ****, it was about the death photos.
Perhaps next time he shouldn't violate obscenity laws. Then you can wank to your hearts content. Plenty of other places to get free **** on the net.

You should research the case more. It was not about death\gory photos for ****.
The rules are simple, None-paying members, such as myself, are not allowed into the purely amature parts where real people actually post pics of themselves. There was one way to not pay, post a picture of the wife\girlfriend that was guaranteed real, this was done mainly by posting several pictures that showed you had pics of the girl and she was yours, or a fan sign that made it clear that she was your girl or that the member was the girl.
But, as a yank and being a patriot he made a new rule. A servicemember in Iraq or Afghanistan could post a fan sign, all he had to do was pose somewere you could se he was not in the US, in uniform and all that, holding a sign that said "hi NTFU <<his nick>>" and he was a member.
There was never any mention of "post a pic of a blown apart corps and you get ****". And that is not what he was arrested for, he was arrested for "obscene" pictures showing anal *** and other cases of consentual *** between two (or possibly more) adults in the privacy of their own home and willingly posted on the internet.

That's a business transaction, which when utilising obscene content(the death photos), is a crime. That's why Faces of Death can't be sold here either. He commited those actions and posted the photos on his site, nothing else matters.

That's a business transaction, which when utilising obscene content(the death photos), is a crime. That's why Faces of Death can't be sold here either. He commited those actions and posted the photos on his site, nothing else matters.
But the "death" photos couldn't get you access. That was just a part of the site, you had to post a pic showing you and maybe your mates smiling and waiving holding a sign to get in, the whole gory section was just there for those who wanted to share what so many other forms of media (including MP.net if i might add) refuses to show, the actual face and cost of war.
The charges don't even include the gory pics, it's just about **** they thought was over the top, and that stuff was just your basic ****. The charges will never hold in a court, no way in hell.

Aye, but a soldier stuck in Iraq, where women are far and few between and trying the local girls would mean all her 200 male relatives came and made you a eunuch, isn't watching **** the safe bet? p-)
There's a lot of women on that site too, who post pics of themselves willingly and enjoy it.

I am a member of the site too, I hope it is up and running again soon. Really, guys, I am not a pervert or anything, it was simply a good, amateur **** site where one posts pics of his couple and stuff.
