I just went to dinner with the wife and a couple that we are friendly with and I got some interesting news on Kazaa.
A friend of theirs from Cookeville, TN ( small town with a smallish TN univ named TN Tech) was still using Kazaa as of about 3 weeks ago and downloaded 6 songs by Pearl Jam. Then about 2 weeks ago he got a letter from his internet sevice provider about a subpoena to get his personal info. Then he got a letter - I don't know if it was a lawsuit or just fines - that said he owed $2500 per song. He ended up "settling" for $3000 total.
That was the story anyway. The details are funny and some don't make sense - plus it is second hand. I am going to try to find out more b/c their is something fishy about this. He never had a lawyer and our friends did not have a lot of details. I'll work on that and pass along ASAP.
I wonder if anybody has heard anything like this in a small town like Cookeville?
Is anyone still downloading from Kazaa?

Canada's recording industry is threatening to launch legal action against Canadian Internet users who illegally share music files online.
The head of the Canadian Recording Industry Association, Brian Robertson, says his organization will target Internet music uploaders who allow people to access music stored on their computer hard drives.
Robertson says the music industry has been "devastated" by file sharing. He says his group has spent more than $1 million on "a value-of-music public education campaign,'' but the file-swapping continues.
According to CRIA, which represents Canada's major record labels, sales of compact discs in Canada have fallen by $450 million, or 23 per cent since 1999.
Robertson would not say when the legal action would be launched, noting "it would be sooner, rather than later.'' He said the legal action would be similar to lawsuits filed in the United States.
In September, the Recording Industry Association of America launched 261 lawsuits against users who uploaded or shared files using software like Kazaa. The targets included a 12-year-old girl who settled her case for $2,000 US and a 71-year-old Texas grandfather.
But there are some doubts about whether similar lawsuits would be successful here, since Canadian laws on reproducing music for personal use differ.
For example, it has been legal in Canada since 1998 to make a single copy of a recording for personal use, such as copying a CD onto your hard drive or MP3 player. But the practice is illegal in the U.S.
But under the Copyright Act, it remains illegal to give or sell a CD copy to a friend, since it's not for personal use. In the same vein, distributing copies to friends online is prohibited.
Last week, the Copyright Board of Canada gave the go-ahead on a new levy for MP3 digital audio recorders with non-removable memory. The board ordered tariff of up to $25 be applied to recorders, depending on the size of their memory.
The fight to add levies on recordable devices was spearheaded by a group representing the music industry, the Canadian Private Copying Collective, which wanted compensation for lost sales.
The group, which collects the tariffs on behalf of performers, songwriters and music producers, argued that more money was needed to compensate them because of the widespread practice of downloading music.
Meanwhile, SOCAN, the Society of Composers, Authors and Music Publishers of Canada, is arguing before the Supreme Court of Canada that Internet service providers should pay a blanket royalty fee since so many users are downloading music.
They say that because of illegal downloads of copyrighted content, ISPs should pay a blanket annual royalty -- regardless of whether the ISP is transmitting legal or illegally downloaded music.
Jay Thomson, president of the Ottawa-based Canadian Association of Internet Providers says if the suit is successful, consumers could see an increase in their Internet costs and a slowdown in the transmission speed of their Internet communications.
A decision is expected next year.

If your dumb enough to continue to use programs like Kazaa you dont even deserve to be able to settle. Stupidity should be expensive.
It is mind boggling to me that anybody would use Kazaa, or Morpheus or some other service that has hit the media waves and the government has been actively cracking down on that particular service( Kazaa) for over a year now.
Jesus, just use Bit Torrent or WinMX or any DC++.
Sure its not as pretty as Kazaa, but it is safer.

Kazaa is crap, I'm using dc instead. Getting a 15000$ lawsuit for downloading 6 songs, is beyond all limits of common sense, although he manged to settle it for 3000$. I have seen letters written to ISP's here in Norway by lawfirms working on the behalf of the big entertainment companys (Warner, BMG...) and the "penalty" to the end user is if any is a letter from the ISP with the threat to end the subscription.

I dunno... I've gotten some really good stuff that I haven't been able to find in the stores.... I have a bit of a soft spot for Fintelligens, which is what I'm downloading at the moment. I don't believe their CDs are available in the States.

I really like Sarah Brightman too... her voice is amazing.... (I had a Phantom Of The Opera Highlights cassette, and I wore it out because I listened to it all the time. Then I burnt a copy of my friend's Phantom CD, which was the full soundtrack, and now I'm always listening to that.)
So I'm a sucker for a good Broadway musical....
But my all-time favourite stuff to listen to is Finnish hip-hop.... I've only been able to get it off Kazaa...

Illegally reporduced? It is perfectly legal where I live. Downloading music and movies are legal, but not to spread it.

I've tried searching for them on a bunch of the online CD stores like Amazon. No dice. When I searched with MSN, I found most of the pages that had anything to do with were in Finnish so I couldn't read them. Damn details.

DC++ is the way to go. You can use a program called PeerGuardian, then
these monkeyboys can´t download your filelist an so forth. And even if they
can it´s illegal, atleast here in Sweden, for them to trace my Internet traffic,
only the Internet provider is allowed to do that, and only during certain
circumstances. In the near future programs can encrypt what you are downloading
for the Internet provider as well, so instead of FLT-BW1.bin they´ll only see
"et´riefiwert34tft Eef".

Illegally reporduced? It is perfectly legal where I live. Downloading music and movies are legal, but not to spread it.
Incorrect - if you download music protected under the US copyright laws you break US law - admittedly the US would have serious difficulties enforcing that law against you in a foreign country unless your government helped US get their hands on you - but that is not the point. As someone else said here - it is the music (specifically the intellectual property meaning the idea that create the song) that is protected not just the CD itself.

You may be right.
If it was a lawsuit and the guy did not have a lawyer then he has a possible malpractice case against the record companies lawyers. Courts do not generally like civil settlements with unrepresented defendants. But the way they described it to me it does not cound like a lawsuit - or maybe not a specific lawsuit against this guy in Cookeville. If it were lawsuit he would have to have gotten a complaint, summons, etc. - that apparently did not happen.
The other option is a fine - but then I wonder why they, whoever they is, would reduce it. I mean if you got 6 speeding tickets they would not write down the total amount of the tickets now would they.
I admit it is strange indeed and I will try toget more info.
Still, I think I would stay away from Kazaa in the US if it were me or if I were advising you as a lawyer, which I am not.
