Leniency for 'ignorant' woman who hurt baby

"A BANGLADESHI woman who shook a baby boy so violently that he suffered brain damage walked free from court yesterday because a judge conceded that she did not know how to behave in the West http://img.moneysavingexpert.com/smilies/speechless-smiley-040.gif.

Rahella Khanom, 24, caused the five-month-old boy in her care to suffer fractures to his breast bone and ribs as she tried to rid him of evil spirits, Southwark Crown Court was told.

The injuries inflicted on the child over several weeks had caused one side of his brain to shrink. It was believed that the boy would have been screaming in agony for eight weeks because his injuries went untreated.

Khanom, from Poplar, East London, said that she had wanted to purge the baby of evil spirits as it cried and cried. She was not found to be mentally ill.

The court was told that Khanom, a Muslim, did not understand that shaking a helpless baby would not exorcise an evil spirit.

Judge Rodney McKinnon told Khanom: “Normal and right-minded people will be horrified by this. Everybody must recognise how serious it is to treat children in this way and to use violence.” But the judge said that Khanom’s strong cultural and religious beliefs, and the fact that she had been forced by her husband to live in isolation since coming to Britain from Bangladesh, meant that there were exceptional circumstances in her case.

He said: “You are a young lady who came from Bangladesh. You lived there in a rural community, adopting the customs and ways of the people there so that getting to know the ways of living in the West and in this country were not easy.

“I accept you were kept really quite isolated from our society by your community and it would seem to a large extent by your husband as well. Under these circumstances I do not feel it is in the public interest to pass an immediate custodial sentence.”

Khanom was given an 18-month prison sentence, suspended for two years, after admitting one count of cruelty to a person under the age of 16......."

wtf, legalised child abuse? PC gone mad?!

I feel very sorry for both her and the baby.

And I do think this is a very unusual case which the judge has made a great effort to understand. He clearly states the reasons why he made the decision to let her go.

There is a problem in this country with cultures properly assimilating with the Mother country (UK). What is absolutely shocking and wholely reprehensible is the manner in which communities are ghettoised in this country. It needs to be dealt with otherwise how can they be expected to assimilate our values?

Tragic that the case must be highlighted through this kind of suffering.

As messed up as it is the judge made the right call.

"The court was told that Khanom, a Muslim, did not understand that shaking a helpless baby would not exorcise an evil spirit."

Did she understand after she broke the child's skull and chest?

The skull and chest were broken by the evil spirit as it fled the body. That's why in countries like Sh1tstainistan, it's not child abuse to shake the kid until they're braindamaged (or whatever), because whatever damage they end up with is the result of the evil spirit having left the body, and proof it was there in the first place.

I'm tempted to agree, but also tempted to disagree. Shouldn't there be a certain minimum amount of common sense that ANY mentally competent person (and, with some differences, incompetent) should be held to? Or is "I'm sorry for severly injuring this child your honor, but I'm too stupid to have known any better" a suitable defense? Ignorance of the law is not a defense in most places, right? Should just plain ignorance be a defense?

Then no excuse....maternal instinct should kick in somewhere, that shaking your infant is harmful....

"Did not know how to behave in the West"???

She does not know how to behave as a human being!!And certainly doesn't have the mental abiltiy to be a fit mother...........

I totaly agree with you bridget and joe mama I see your twisting about as I was, in the end I think the judge made the right choice but damn what a tough one.

Perhaps the judges verdict can be viewed as racist since he believes "brown" people don't know how to treat children properly like we do in the West?

Not only is it racist that he believes that, he freed her specifically because he hopes she'll visit all her friends and relatives and they'll want her to shake their babies to rid them of the evil spirits since she's proven to be such a good anti-evil-spirit-baby-shaker! She's the Bangladeshi Blade...except she goes after evil spirits and he goes after vampires...and she's not so black that she's almost purple like Wesley Snipes...and any movie about here probably won't have Tracy Lords stalking thru a meat packing plant in the beginning looking blisteringly hot...

I'm with bridget. I'm usually the first one to recognize the differences between cultures and support that, but this goes beyond that. Even apes know better to shake their young until they die. This person is either insane or too stupid to function in any society.

This particular problem doesn't appear to be prevalent amongst Britain's Hindu community so why should a Bangladeshi Muslim woman get off the hook regarding this violent offence?

Britain's prisons are becoming increasingly crowded with Bangladeshi and Pakistani Muslim offenders but their is a dearth of Hindu inmates.

What gives?
