Victim's injuries deemed not `serious'

Citing a lack of “serious injury,” the Special Investigations Unit has terminated its probe into allegations that two Peel Region police officers assaulted a former Argonaut linebacker. Orlando Bowen was arrested March 26, 2004, in the parking lot of a Mississauga nightclub. He alleged the two officers assaulted him during the arrest.
Bowen was released the following day and went to William Osler hospital for treatment of his injuries.
Last March, Bowen’s lawyer notified the SIU that his client suffered serious injuries, including a concussion, bruising and cuts, as well as continuous physical and psychological symptoms.
In its probe, the SIU confirmed Bowen suffered from soft tissue injuries, but it also looked into whether his complaints constituted a “serious injury” that falls under the agency’s mandate.
“I concluded that Mr. Bowen’s concussion, which was characterized as a mild concussive head injury, did not fall within the boundaries of a `serious injury,’.’’ SIU director James Cornish said in a statement. “In coming to this decision, I noted the medical information that indicates Mr. Bowen did not sustain any neurological damage and did not suffer any loss of consciousness or memory.”
Cornish said he didn’t want to minimize Bowen’s injuries and suffering.
“My use of the term is in its strict legal sense for purposes of our statutory mandate,” he said.
The SIU investigates police incidents where a suspect is seriously injured or killed.
Bowen was originally charged with assaulting the two officers and possessing a small quantity of crack cocaine. Last December, a Brampton judge acquitted him on all charges.
Bowen, who is suing Peel police for $14.6 million, alleges the officers not only beat him but planted drugs on him when he was originally arrested.
Bowen, who played linebacker for the Argos between 1999 and 2002, worked with Peel police in their anti-bullying campaign at various Peel schools.
