    Well said, when someone is attacking you what do you do? I think any sane person would defend themselves. And according to the article, the officer and his freinds already made several attempts to run away and difuse the situation, but what do you know, Mr. durnkard just followed them! Perfectly justifiable in my opinion anway.

    I agree with the officer. if someone is coming at you and throwing punches,while and after you tried to get away? drop em'. End of story.

    All this " if I run away he won't hurt me anymore shyte is for the birds. If someone is attacking, or actively chasing you, he wants to kick your ass, and there's no two way's about it. If you can't get away, you're gonna have to stop him.
    This guy was attacked, and he effectively defended himself. With the amount of witnesses, and the fact that the kid had to have found out at some point, he was a cop, should've been it.
    I've seen it (been a witness to a cop assault) first hand and this is just crazy. My question would be, who does this kid's family know that the judge would admit a crime was committed by the plaintiff, and ignore it?
    The unfortunate thing about this is that it scares people into pacification by not defending themselves, when it's the only option to end the encounter.

    Fright-flight-fight-, as opposed to fright-flight-beatdown will get you five yrs..

    Crazy stuff... that punk was begging for it and got what he ordered.

    I think this cop showed enough indulgence. Most people wouldnīt take so much sh!t before going postal.

    In some states you could go inside your house, get your 9mm Para and shoot someone because you were "feeling threatened" and than you hear stuff like this. Crazy.

    Maybe the officer meant left side chin/jaw as a righty, will hit the left side of the moron.

    This guy will more then likely win his appeal, I was working a security gig in a neighboring town at a frat party and got into a scuffle with some drunk frat guys and there officers were thanking us for kicking there asses. totally oppisite of this situation.

    Fvck Chicago. My cousin was killed there, and all perp's punishment consisted of was minor fines and a vehicle infraction

    I though t this bloke had stolen my phone so I chased him down threw a few punches at him then he decked me I mean how unfair is that?

    Something seems weird about this. A couple of drunks getting into a scrap, fists fly, the cops show up and an off-duty cop gets hooked? I've never been to Iowa so I don't know local custom, but I'm guessing the off duty guy mouthed off to the locals in some manner to make them make the arrest or somebody's dad/uncle/mother has some influence with the town. Either way this guy is screwed.

    Cop or not, drunk or not, he retreated to his own front yard, how far does a man have to go to avoid a fight???

    As a person he showed enormous restraint to get that far, and even greater restraint to be assaulted a couple of times on his own property without defending himself. any man has the right to self defence when threatened. this is another case of the western worlds love of litigation and political correctness. where the F**k is the common sense these days??

    Yeah there's more to this that as usual the media isn't reporting to either sell papers on sensationalism or to further their agenda.

    5 years is a long time, regardless if the guy was a cop or not, that shouldn't really make a difference to the sentancing if the articles report is acurate. However I'd imagine there's something fishy about it that is being omitted, else why would the other cops arrest him and why would he get charged and the other person not? Things like that don't happen for no reason, I just wonder what the reason was, I expect it had to do with his behaviour and actions before and after the fight (specific I know :P ).

    a judge in Iowa this week sentenced Mette to five years behind bars for slugging a Dubuque college student, even though the judge admits Mette was being attacked at the time.
    where's the problem? Isn't there a right to defend yourself when attacked?
    How can anybody demand from him to run away?
