Someone here is selling a OTV vest. I would like to purchase it but the guy went AWOL. He's not allowed to have it correct? If he isn't, he sure is hell isn't allowed to sell it right?

Well my friend (US Army) who works at a surplus store said, everyone has to return their combat gear that's issued to 'em. He said if they are out of the Army it didn't matter, and thats how the surplus store gets a hold of MICH helmets and IBA's and etc. I just figured if this guy went AWOL, shouldn't he have to return it as well?
You can either buy it & have no worries or buy it & possibly the authorities find out you have it & you get busted.
or you can report this guy to the authorities & they can lock him up if he is AWOL.

And as far as I know, there are also people who have legally purchased IBAs as well.You can buy the covers from SDS directly for about 140 $.Not saying this guy isnt actually pawning US prop. In which case you should run away fast.

FYI - OTV and IOTV that are issued by the US Mil are the property of the US Government. Whereas, the US Army MPI/CID do not go out of their way to hunt down AWOL/Deserter Soldiers - if thrown a bone...especially covered with the gravy of selling a controlled item....they might just bite.
Article 80 and 134 of the UCMJ (Felony level!) on top of Article 85/6 and throw in Article 90/1/2 for good measure - a GCM or BCD/Special for that guy - thanks for playing!

As far as him going AWOL/Deserting - the fact is - they usually don't stop by CIF and turn in their gear before they run away.

The Army is very cooperative with deserters if they turn themselves in. If he was important to the Army (high rank, etc) , and they had invested alot of time and money into the guy, then he'll see the brig, that is very rare.
What do you mean, cooperative? Do they just tell them it's okay and don't punish them? I never took too much time to read articles of the UCMJ while I was in, but couldn't they technically still firing squad your a$$ in a time of war? Hey, it might be a dumb question but I've never seen anyone chickensh!t enough to run before. A guy in my platoon found religion thanks to his new bride and became a conscientious objector about 7 years ago. At least he had the guts to admit he couldn't kill someone, instead of fleeing like a coward.
There has only ever been one execution for desertion within the US military, it was Pvt. Eddie Slovak during WW2. This was done to prove a point to other soldiers that going AWOL wasnt smart. Hundreds of soldiers went AWOL in late 1944 because they believed the war would be won before Christmas.
If you turn yourself in, you go to a PCF, they hold you while your paperwork is processed. you sign your paper and leave within 3-4 days with your DD214.
