    Philippine 'rape' victim recants


    A Philippine woman who secured a rape conviction against a US marine more than two years ago has now suggested the *** was consensual.
    A statement from the woman, known as Nicole, says she is tormented by guilt.
    Lance Corporal Daniel Smith was sentenced to 40 years in jail. He is currently being detained at the US embassy in Manila, pending an appeal.
    The case had stirred anti-American feelings in the Philippines, and strained ties between the two nations.
    "My conscience continues to bother me," Nicole wrote, "realising that I may have in fact been so friendly and intimate with Daniel Smith at the Neptune Club, that he was led to believe that I was amenable to having *** or that we simply just got carried away."
    Nicole had previously testified that Smith took advantage of her drunkenness to rape her in a parked van.
    The incident was alleged to have occurred after the pair, who had just met, drank and danced together in Subic Bay, the site of a former US naval base.
    Smith insisted throughout the trial that he was innocent and the ****** encounter had been consensual.
    Following his December 2006 conviction, he was transferred to the US embassy in Manila, in a move that was fiercely contested by Nicole's supporters.
    They were incensed to see the marine escape the harsh realities of Philippine jails.
    The embassy insisted that under the Visiting Forces Agreement, which regulates the presence of American counter-terrorism troops in the Philippines, the US was entitled to retain custody of Smith until the end of the legal process.
    The case strained relations between the two countries, and led to vocal calls in the Philippines for the abrogation of the VFA.
    Nicole's new version of events has shattered certainties in the case - although some Philippine left-wing activists have suggested both governments may have leaned on Nicole to change her story in order to keep the VFA in existence.
    Philippine Justice Secretary Raul Gonzales expressed annoyance at the latest turn of events.
    He said Nicole's allegations had affected the country's foreign policy and suggested she could be charged with perjury.
    But Nicole's whereabouts are unclear.
    Her lawyer said she had been informed by her client's mother that Nicole had now emigrated to the United States and no longer wished to talk.

    Gee what a shock.. Just like those anti-us protesters you see in the Philippines..Many of them are paid by persons that want to disrupt the Philippine government. Fact.

    what a disgusting bitch. She probably failed to persuade the marine to take her to USA and accused him of rape afterwards cause he refused.

    The irony of it.Gets him convicted, emigrates to the States and recants her story.Nice.Is there any likelihood that based on this, they will release him?

    Basically, the left rode in on a party and made a national problem out of what would have been a simple issue. The girl already has an American bf, yet still went to Subic to party with some US Marines... floosie. But Filipinos being run by emotions, saw it as the big bad Amricans taking advantage of an innocent lass (which basically insulted all the innocent lasses in the country). She got what she wanted (a Visa or greencard) recanted an basically made a fool of the Judiciary and the Philippines.

    As to the question if Smith will be set free, would take the Us all its got to do it. since recantations in cases involving rape is seldom considered and always suspect even in the U.S. The Philippines to save face will most likly stick to the story that the lady was bribed by ze Amerikans, so judiciary might consider it as a crime against the people and stick to the decision. So if they can... Smith stays.

    What a friggin' liar, she used the system and the hateful feelings of her people. And who's left in the brig-the Marine... Was this her real purpose-to be able to go to the U.S.?

    I got pissed when I heard the news. She'll most likely be charged with perjury by the Justice Department. Serves her right.

    Are you Filipino? The reason I ask is cause I'm from the Philippines myself and in the 11 years I've been away, that is the one glaring thing I've been able to observe about the Philippine psych - making rash decisions based on emotion. Especially when the circumstances involve saving face.

    A sad case really.

    Her words seem very carefully scripted. She still did not say she wasn't raped.

    It's sounds a bit too much like the old "she had a sexy dress on and danced provocatively at the club.... she was asking for it" defense.

    Does seem like she would have had quite a bit of pressure on her even though she won her case.

    What were the "certainties" that secured the conviction. Courts do not convict simply on one persons word over the other. There is usually evidence to support one persons claim more than the others.

    And why did he pay “Nicole” P100,000 in moral and exemplary damages before she left the country?

    Why was she given access to the United States following the case?
