    WASHINGTON (*******) – President Barack Obama picked solicitor general Elena Kagan as his nominee for the U.S. Supreme Court, NBC reported on Sunday, choosing a relative moderate who may still face questions from Republican Senators on gays in the military.
    Very anti-military

    Some on the left dislike her for the following:

    During her confirmation hearing last week, Elena Kagan, the nominee for solicitor general, said that someone suspected of helping finance Al Qaeda should be subject to battlefield law — indefinite detention without a trial — even if he were captured in a place like the Philippines rather than in a physical battle zone.

    Ms. Kagan’s support for an elastic interpretation of the “battlefield” amplified remarks that Attorney General Eric H. Holder Jr. made at his own confirmation hearing. And it dovetailed with a core Bush position. Civil liberties groups argue that people captured away from combat zones should go to prison only after trials.

    Except for the fact that the civilian body can rule on issues that effect the military. Like college campus recruitment .

    I get that bad feeling from her...

    On some issues, like the 2nd Amendment, almost nothing is known about Kagan’s views. She moderated a debate on the issue in 2003, but law professor Eugene Volokh, who defended gun rights at the debate says he learned “nothing at all” about her views on the subject at the event.

    It looks like Obama is pandering to his homo****** constituency with this nominee. She's not even a Judge, so there are no rulings by which to gauge her jurisprudential outlook.
