    Default India loses appeal; Salem headed back to Portugal?

    New Delhi/Lisbon: In a major embarrassment for India, the Supreme Court of Portugal on Tuesday dismissed an appeal of the Central Bureau of Investigation (CBI) challenging termination of extradition of underworld don Abu Salem.

    The High Court of Portugal’s capital city, Lisbon had in September last year terminated the extradition of gangster Abu Salem, who is an accused in the 1993 Mumbai serial blasts, for breach of agreement by India by slapping charges which attract death penalty.

    Maybe he should have an accident while in jail. Will save the Portuguese and Indians a lot of trouble.

    Also, does he need to be sent back to Portugal? He is an Indian citizen. Anybody aware of the legal situation?

    Portugal's laws do not allow extradition to any country where the accused can be awarded death penalty. With criminals like Salem, there are hundreds of narcotics, terrorism related, organised crime and homicide charges for which fresh witnesses and evidences keep turning up. Portugese fear he will be awarded death penalty ultimately (despite an assurance from the Indian govt), so the extradition is being cancelled.

    Legal issues sucks.
    Yup if he would "die" in jail would save alot of paperwork and ink.

    I think its a rater easy problem to solve, just make a diplomatic written agreament that legally binds Indian justice not to execute the guy and he can pack is bags get off my country and go pay for its bad deeds in India.

    Im not a sucker for death penalty it seens an easy way out for some people for the suffering they inflicted on others, but Portuguese law (im portuguese mind me) is too light cause maximum sentencing here is 25 years, some people deserve to lock up and throw literally the key away!

    He has already been extradited to India. The question is now that your SC has cancelled the extradition, are we legally obliged to send him back to Portugal; if you want him back...that is.

    Its not whether they deserve it or not. What's important is the security of the society. Some rotten elements have to be separated permanently and there is only two ways of doing that. Lock them up for life or the capital punishment. I don't know about you but the second one is a lot cheaper.

    Yup it is but...
    Justice here is pain to get to a conviction.

    In the case of the post, he has been extradicted but if it as been cancelled if hes not returned it will open a precedent and next time someone is caught in Portugal i dont think India will ever get its hands on the person.

    It is just sickening that a person who has the blood of 250 persons on his hands is still breathing. I hope Chhota Rajan gets him while he is still in India .

    1993 serial bombings, over a couple hundred assassinations ordered by the D-company during their reign of terror, smuggling arms and explosives for terrorist organisations, consorting with a foreign secret agency in waging war against the country, laundering several billion dollars, narcotics smuggling, prostitution and human trafficking, extortion, subjugating witnesses, targeted assassinations of law enforcement and government officials.... this guy has done it all. He will probably serve his prison sentence for carrying forged documents in Portugal and go off the map again.

    Default India has no locus standi in Abu Salem matter: Portugal top court

    NEW DELHI: Rejecting India's plea, Portugal's top court has questioned its locus standi in challenging the order cancelling extradition of underworld don Abu Salem to this country.

    Salem, who is accused in the 1993 Mumbai bomb blasts case which left 250 dead, was extradited on November 11, 2005 from Portugal where he was arrested in 2002, along with his girl friend Monica Bedi.

    Agency sources said while it will examine legal remedies, there is little possibility of Salem being sent back.

    Whats the locus standi ? Abu Salem is a mass murderer and will kill many more once he gets out, hows that for a locus standi.
