Default Prosecuting NATO for war crimes in Serbia? Νο, and you will be surprised why.

    David Akerson says:
    January 3, 2012 at 12:47 pm

    Dear Kostas,
I am afraid you are simply wrong about the ICTY with regard to NATO and with war crimes. The ICTY was quite correct in concluding after their investigation that a prosecution of NATO was not warranted.

The fact that both sides in a conflict committed violations of the laws of war do not mean:
    1) They are equivalent violations
    2) They are both prosecutable under the empowering statute which limits jurisdiction to serious violations only.

NATOís offenses were simply not major violations of the laws of war and should not even be discussed in the same breath Serbian offenses. The Serbs (and Croats) committed massive crimes and more importantly they involved violence directed specifically at civilians on the basis of ethnic hatred. NATO was targeting military objects or dual use objects and incidentally affecting civilians. And NATO was motivated not by ethnic hatred but was rather trying to stop the Serb crimes.

NATO crimes are simply not of the same magnitude as the belligerentsí crimes and they are certainly not worthy of prosecution at the Intíl Tribunal forum. The best case for a serious NATO war crime is the attack of the TV headquarters. It was a single attack that resulted in 16 casualties. Comparing that to the 200,000 innocent civilians targeted and killed and 1,000,000 displaced in the Balkans ó that is the travesty.

All of us should be proud of the accomplishments of the ICTY and its contributions to the international rule of law. It has done a fine job in impossible circumstances.

You make a thread that isn't about the substance of the article but about a Comment on the article? WTF?

And Ackerson holds what Official position at the ICTY? oh None...

So what? His argument stands, and does a good job at that.

His argument is valid if, and only if, we would have evidence for a collective "serb" guilt in the whole yugoslav civil war. AFAIK there no such a verdict, let alone proof.

If it really is Akerson the former ICTY attorney, then it is relevant as a public statement imo...

BS. Iraqi WMD's was never a lie. The Yellow Cake uranium thing was a lie, but other than that the rest is for the most part true.
