I would be very, very, very surprised if they turn out to be pirates. But let's wait till the full facts come out.

yes sir. in fact the article state that only warning shots were fired and after the third string they went away.
Battaglione San Marco is (IIRC) the amphibious assault troop that depend by the navy

CNN-IBNKochi, Feb 15 (PTI) Two fishermen in a country boat were feared killed after security detail onboard a merchant vessel allegedly fired at them off Alapuzha coast this evening, suspecting them to be pirates. A naval press release tonight said that the personnel onboard 'Enrica Lexie' had allegedly fired on the fishermen mistaking them for pirates. The vessel informed authorities about the incident. The Coast Guard then launched two ships 'Sumar' and 'Lakshmi Bai' and an aircraft to trace the ship, located it and asked it to anchor off Kochi for a detailed investigation. INS Kabra from the Southern Naval Command was also put out to sea for the operation. The fishermen from Kanyakumari in Tamil Nadu had put out to sea this morning from Neendakara in Kollam district.

So i take it the italian ship did not try to engage in communication with the other vessel? like signalling them to divert their course, before firiing warning shots. The articles posted were not clear on this... and i cannot read italian.
I guess there are no internationally accepted procedures for cases like this, when an unidentified ship is aproaching a nother vessel?

yes there are. international code of signaling (INTERCO) is used for this exact purpose and i guess you have to know those signals if you own/pilot a vessel. anyway i dont know much about navigation laws but i think that if they were approaching a vessel without coms it looked legit to shot the warnings. the second point is, if they shoot ONLY warning shots, how can they hit the vessel? it's really smoky atm to me.
Seems like we'll have to wait for more details to be released...
Isn't this the same folks that do "catch and release" with actual pirates in the golf of Aden citing ROE? coast of Kerala? something is missing here.

The incident is believed to have occurred about 14 nautical miles off the Alappuzha coast.A defence spokesperson said, "The Indian Coast Guard district headquarters number four has launched CGS Samar, CGS Lakshmibhai and an aircraft to pursue the Italian ship. The aircraft has since located the ship and has asked the vessel to come to anchorage off Kochi for detailed investigation."
The following statement is not intended to defend the shooters:
Pirates that close to India is not beyond the realm of possibility.
Foreign pirates 14 nautical miles off the Alappuzha coast is pretty much beyond the realm of reality.
But since it is confirmed that the dead were Indian fishermen, that point is kind of moot anyway.

Pirates in 14 nautical miles from Kerala coast??? Maybe they came to check out our new 'aircraft carrier' that is building in Cochin shipyard.....
I hope truth will come to serve justice to those fishermen.
