All species (I'm assuming these are acorn woodpeckers) are protected under the Migratory Bird Treaty Act of 1918.
(2 species are endangered!)
They are not vermin.
That is their natural habitat, these aren't feral birds.

Penalties may range as high as a $500 fine and 6 months in jail for killing a woodpecker.
Penalties are much stiffer if it's one of the two endangered species.

Just kidding, I wouldn't do it again. I was young and naive and looking for an excuse to shoot something. Spending a summer in a cabin in the woods and constantly waking up to the sound of a woodpecker drove me bonkers.

Generally, there must be a good case to justify issuance of a permit.
If you google search, there are lots of other options for damage prevention and control.
