    VERY badly... how is this even up for argument? Canada isn't a police state.

    That insane, histrionic teacher should be disciplined and an apology is in order for putting this entire family under duress based on nothing. A drawing of a gun shouldn't be grounds for interrogating a toddler, let alone subjecting anyone to the indignity of a strip search.

    just a while ago i've read about a neighbor saw a child who ran till death and assumes nothing wrong with it...

    while i don't laud the teacher's action,i don't blame the teacher either.he/she just being concerned about the well being of his students

    You know how you check your speedometer, when you see a black and white in your rearview mirror? Since I seem to have gotten the attention of a few red usernames, would you advise me to lay low or try to answer your question?

    Perhaps one of the Canadian coppers on here could tell me if police can make an arrest based on suspicion or if they need the same as here - probable cause. (Or a warrant based on PC). There is significant difference between reasonable suspicion and probable cause. Was it necessary for an investigation to see if children were in danger because they had alleged access to an alleged firearm? Maybe. But there is NO WAY based on a singular interview with a 4 yr old they developed probable cause to make an arrest or even get a search warrant for the house.

    Not arrest on suspicion but on reasonable probable grounds. If suspicion you can detain to investigate. Generally warrants for firearms for the interest of public safety are pretty easy to get. But who knows if they even got a warrant to search the house.

    So is there a public safety exception to warrants on suspicion of an illegal firearm being in a home?

    Just trying to see how things are different...Im pretty ignorant on Canadian law. Here we need probable cause (suspicion alone wont do it) for a warrant unless there is a public safety issue and it has to be a significantly clear threat to public safety or the safety of a citizen inside the home (violence/threat of violence occuring).

    Under US law most searches of residences, conveyances, etc. require a search warrant issued by a detached magistrate upon the presentation of facts by the affiant. The presentation of facts should equal probable cause (a level of proof above reasonable suspicion but below a preponderance of evidence). However, there exceptions where LE can conduct a search based on exigent circumstances; one of those is a public safety emergency. The standard example being an officer has PC to believe a bomb is in a location that would normally require a SW for him to enter but because of the exigency of the impending detonation they enter and find the bomb w/o first securing a warrant.
