I think you're right. Too often, politics gets in the way of soldiers doing there jobs and it is going to do more harm than good.
Reasonable doubt.... Would a normal person come to an IED site, would a normal person drive close to a fire fight, wait 9 minutes and go directly to the trunk of their vehicle. Code of Armed Conflict, should be on this guys side. This is some ass clowns way to get famous, by hanging a Soldier out to dry.
Such a shame she died. In my opinion I believe it is a crime! Why would she wait 9 minutes then get out of the car if her intentions were bad? Wouldn't she get out and detonate the bomb right away and not leave them to adjust to the situation if she wanted to hurt them?
I alway side with the combat soldier. In my opinion, he/she is innocent till proven guilty. None of us were there.

Modus Operandi can never be certain with terrorist operatives. You never know what their strategy maybe. She could have needed time to finish her prayers or given time for a crowd to form to initiate a secondary explosion, or just working up her nerve. In this kind of situation you never know who's going to do what and you just have to be ready for anything.
Are you comfortable? Nice and cozy isn't it, sitting there, having minutes to read and read again the situation that unfolded in some stressful seconds to this man whom you feel you can judge.
As was stated those nine minutes could have been for others to amass at the scene, as they did in Chechnya too. Or it could have been that wire he "saw", maybe the remote trigger failed, they waited and sent her out to set it off manually.
If I cross in front of heavy machinery, I make eye contact with the driver, I make sure my intentions are clear and I won't become a burger on the asphalt. If I am stopped by a nervous cop I wouldn't do anything unless my intention was clear, and my actions asked for by the officer or made clear by me to the officer so I don't get shot reaching for my wallet. And hey, this is back home, think this should doubly-so apply to a warzone, she was a Doctor, there had to be some common sense.
As for the legal gears in motion against the Sgt.; I can see why the procedure is necessary, ISAF works hard on lowering the CivCas figures that are a huge setback to any attempt to gain the trust of the locals. It may not be fair that soldiers get bogged down in ROE that seem to make them more targets than soldiers but in this case he shot a female Doctor, hell he practically shot the God damn symbol of the progress that the Coalition is supposedly bringing to Afghanistan, **** luck.
I'm quite certain he won't be convicted, but he will have to serve as a reminder to other soldiers that they can't ignore ROE just because killing anything that may be, could be, would be, is safer than waiting for it to be certain.
